DSP Terms and Conditions
We have tried to make these terms and conditions as clear and concise as possible. If you do not understand a portion of the terms please address questions to support@zaptacular.com.
Section 1: Displaying the sign up box.
1-A You must make an effort to promote the sign up box. Joining a joint venture and expecting the other partners to do all the work for you defeats the purpose of a joint venture. The following are a few ways to promote the sign up box:
=> Display the sign up box on the "Thank You" page for new subscribers to your publication.
=> Display the sign up box on the "Sorry Your Leaving" page for subscribers who are canceling their subscription to your publication.
Note: If you cannot change your "Thank You"/"Sorry" page (Onelist, Topica, etc.) or if you would prefer a different method of displaying the box, please read on.
=> Provide an exclusive space on your site devoted to the sign up box and link to that page from at least one prominent place on your site (preferably your home page).
=> Run one ad per calendar month in your publication advertising the page on your site where you placed the sign up box.
1-B You may display the sign up box in a pop-up window. It is strongly suggested that you use the following tips when using this method of promotion. They will help maximize your subscription rates.
=> Utilize a JavaScript that allows you to limit the number of views per specific user per day(s). This is accomplished using cookies and there are many places on the Internet where you can find a usable example. Users tend to get annoyed when viewing the same pop-up multiple times in the same day/week/month/. The obvious minimum is to limit it to once a day, but it is suggested you use once every 7 days with your pop-up.
=> Use only one pop-up at a time. In other words, don't have multiple pop-ups bombarding your user's computer, it's a sure way to thwart the pop-up(s') effectiveness.
=> Implement the pop-up when the page exits, not when it loads. Using a pop-up when your page first loads leaves the user feeling as if they are being targeted before they even know what your site is all about. Instead, using a pop-up when the pages unloads ( when the user clicks on a link or exits the site/page ) gives them an opportunity to check out your page and decide where they want to go before being introduced to your pop-up.
Section 2: General Restrictions and Requirements.
2-A It is strongly suggested that you limit any third party advertising on any page that displays the sign up box.
Placing the sign up box on a page filled with banners and animated images will distract users and decrease its effectiveness.
2-B You may not attempt to alter or duplicate code associated with the sign up box. The code is protected by US copyright laws and International treaties.
2-C Each issue of participating publications (owners' and partners') must contain cancellation instructions.
2-D Each publication's web site (owners' and partners') must have an easily accessible link which leads to a privacy policy.
Privacy policies must contain a sentence similar to this: "We will never sell or give your email address or personal information to third parties.".
2-E Each publication owner is required to maintain a subscription to the update list.
An update is sent out to alert participants to application upgrades, network upgrades, maintenance, etc. There is no set publishing schedule for update emails.
Section 3: Participation Restrictions and Requirements.
3-A Associated sites / publications must show integrity in the way the recruit new subscribers (NO SPAM, NO BULK LISTS).
3-B Sites / publications that focus on Adult material (dirty humor, explicit content), Copyright infringement, Hacking (destructive), Hate, MLM, MP3 and Warez activities are prohibited from participating in our services.
3-C Sites / publications that promote (in the form of advertising) Adult material (dirty humor, explicit content), Copyright infringement, Hacking (destructive), Hate, MLM, MP3 and Warez activities are prohibited from participating in our services.
Section 4: Payment
Note: This section is specific to joint venture owners.
4-A You *must* pay for your service via paypal ( http://www.paypal.com/ ). Paypal can be used to send payment world wide (see site for details and restrictions). You may fund your paypal account with an EFT or via Credit Card. Learn more at paypal.com.
4-B After being approved, you will receive a payment link in your confirmation email. Account access will be instantly granted as soon as you have followed the payment link and completed the payment process.
4-C Renewal payments are due by midnight on the renewal date. Your account may be closed if your payment is not made by the renewal date.
Section 5: Miscellaneous
5-A Zaptacular.com cannot be held liable for the actions of our clients.
5-B Zaptacular.com's clients cannot be held liable for the actions of other clients.
5-C Zaptacular.com owns ALL rights to software and code related to the sign up box.
Participants (owners and partners) are granted a temporary license of use and retain no rights of any kind after that license is discontinued due to non-payment or expiration of promotional period.
5-D This system (sign up form and account interface) is not 100% percent browser compatible. This system never will be 100% compatible with all browsers.
In order to make the sign up form as easy to implement as possible certain technologies were utilized which may hinder operation while using certain browsers. To view a current list of compatibility issues specific to the sign up form, click here.
If your browser does not support Javascript or you have disabled it (both of which are doubtful, because you are here), you will not be able to log in to the account interface or use many of it's functions.
5-E To prevent data loss during updates Zaptacular.com will cause affected sign up boxes across the network to become hidden to potential subscribers and will also suspend access to the account interface. If possible, updates will be performed in off peak hours to lessen the inconvenience.
5-F These terms and conditions may be modified at any time! Notice of changes will be sent via email and posted at Zaptacular.com. Changes will go into effect no less than 5 days after notice is given.
5-G If you do not comply with any of these terms, your application will not be approved!
5-H If you are already approved and do not comply with these terms,
your publication will be removed from the sign up box immediately!
5-I By requesting to participate in this unique joint venture opportunity, you acknowledge that you accept and agree to be bound by these terms and conditions!
